The La Pensée Sauvage Normandie detox breaks are marketed and operated by SA Forges Thermal, under licence from the La Pensée Sauvage brand. These General Terms and Conditions of Sale (GTC) apply to the sale by SA Forges Thermal of the detox breaks organised by it under the La Pensée Sauvage Normandie brand, and to the provision of all associated services.
PRELIMINARY NOTES
Personal data: the information collected is processed electronically by SA Forges Thermal. In accordance with the French Data Protection Act of 6 January 1978, as amended in 2004, you have the right to access and rectify any information concerning you. This right may be exercised by contacting La Pensée Sauvage Normandie by post or email, using the contact details provided below: La Pensée Sauvage Normandie. Domaine de Forges. Target audience and restrictions:
1. La Pensée Sauvage Normandie holidays are intended exclusively for adults; this means that bookings cannot be made by or on behalf of minors, even if accompanied.
2. Some of the packages on offer involve a significant reduction in daily calorie intake.
Consequently, these packages are strictly contraindicated:
- For those who are pregnant or breastfeeding,
- For those undergoing intensive medical treatment,
- For people suffering from certain conditions, including (non-exhaustive list): peptic ulcers, diabetes, cancer, addictions, nutritional deficiencies, hyperthyroidism, epilepsy, mental health disorders and eating disorders, excessive thinness (BMI ≤ 18),
- If you have a pacemaker.
If you have any doubts, we recommend that you make an appointment with your GP for a preventive health check-up. If you have a diagnosed medical condition or are taking medication, a medical certificate issued by your GP specifying the packages compatible with your health condition will be required to confirm your booking.
Regardless of whether a medical certificate is provided, La Pensée Sauvage Normandie reserves the right to modify the package chosen by the client if it appears incompatible with their level of vitality. In the event of disagreement with the team of naturopaths, a liability waiver for failure to follow the supervising team’s recommendations may be proposed, and as a last resort, a refusal to accept the customer’s booking may be recorded.
I. DEFINITIONS
The parties to these General Terms and Conditions are defined as follows:
- The Service Provider: SA Forges Thermal, a company with a share capital of €15,600,000, whose registered office is situated at Avenue des Sources, Forges-les-Eaux (76 440), registered with the Dieppe Trade and Companies Register under number 775 699 986 and represented by Richard FRISCHER in his capacity as Managing Director,
- The Customer: any person, who must be of legal age and of sound mind, who has made a booking with the Service Provider,
- The Centre: the establishment known as La Pensée Sauvage Normandie, situated at Avenue des Sources in Forges-les-Eaux (76 440), where the services are provided.
II. SCOPE OF APPLICATION
The Service Provider specialises in organising detox retreats based on a plant-based diet, gentle physical activity and the creation of conditions conducive to the participants’ relaxation. In order to provide the Client with a high-quality service, the Service Provider is entitled to have the services ordered performed by any employee or subcontractor of its choice, under its general legal liability.
III. CONCLUSION OF THE CONTRACT
Registration for a La Pensée Sauvage Normandie detox retreat is strictly reserved for adults of legal age and sound mind.
1. The booking becomes firm and final once the following two conditions have been met:
- Receipt by the Service Provider of a deposit of €600 (six hundred euros) including VAT
- Receipt by the Service Provider of the registration form, duly completed and signed by the Client.
2. The Vitality Assessment form sent by the Service Provider to the Client upon receipt of items 1 and 2 is also mandatory. It must be completed and sent to the Service Provider upon confirmation of the booking, on the understanding that the choice of the Detox package will only be valid upon receipt of this assessment, subject to the opinion of the naturopathic team, which reserves the right to direct the Client towards a package better suited to their state of health and/or level of vitality.
IV. PRICING POLICY
Sales prices: Sales prices are always quoted inclusive of VAT.
Stays and services are invoiced on the basis of the current rates, as defined and published for the relevant period. These rates are non-negotiable. They automatically supersede and replace any previous rates. However, in the specific event of a change in VAT (increase or decrease) that could not have been anticipated and which would affect the final price including VAT for stays and associated services, this change would be immediately reflected in the selling prices.
The following payment methods are accepted:
- For the deposit: bank transfer and credit card.
- For the balance of the stay to be paid on the day of departure: credit card, cash.
Payment obligations: Any stay that has commenced is payable in full. The Customer is required to settle the balance of their stay on the day of departure, at the time of check-out. This corresponds to the total cost of the stay minus the deposit already paid, plus any individual treatments and purchases made at the La Pensée Sauvage Normandie shop.
Refunds and price adjustments:
- Whether relating to accommodation, activities, meals or access to facilities, any services included in the stay that are not used by the Guest are non-refundable under any circumstances. This rule also applies in the event of late arrival or early departure.
- Should the Guest need to change their Detox package during their stay, either at their own request or on the advice of the naturopathic team, a price adjustment will be applied, resulting in an increase or decrease in the cost of the stay depending on the nature and number of meals concerned.
- Regarding individual treatments booked by the Guest, appointments may be cancelled free of charge up until 7.00 pm the day before. After this time, they will be due and invoiced to the Guest in full.
V. CANCELLATION, POSTPONEMENT AND TERMINATION OF BOOKINGS
The sale of holidays with La Pensée Sauvage Normandie falls within the category of contracts governed by the right of withdrawal as defined in Article L. 221-28 of the French Consumer Code. The standard 14-day withdrawal period therefore does not apply here, and only the terms of these General Terms and Conditions set out below shall prevail:
1. In the event of cancellation of their holiday, the Customer shall be entitled to a full or partial refund of their deposit, subject to the following conditions:
- Up to 45 days before the start date of the holiday: full refund with no cancellation fees.
- Between 44 and 30 days before the start of the stay: a refund of 50% of the deposit paid, i.e. 300 (three hundred) euros including VAT
- From 29 days before the start of the stay: no refund of the deposit paid. This deposit, amounting to 600 (six hundred) euros including tax, is retained in full by the Service Provider.
- On the day the stay begins: in the event of the Customer’s failure to arrive and excluding all cases of force majeure (see Article XI), the full cost of the stay is due. An invoice for the balance of the price will be issued and sent to the Customer, who undertakes to pay it. However, upon presentation of a duly completed medical certificate, an amicable agreement may possibly be reached.
2. If the Customer wishes to postpone their stay, they may change the scheduled date in accordance with the following terms:
- Up to 30 days before the start date of the stay: the booking may be changed free of charge.
- From 29 days to 16 days before the start date of the stay: change of booking subject to a surcharge of 150 (one hundred and fifty) euros including VAT, payable with the balance of the stay.
- From 15 days before the start of the stay: postponement is no longer possible.
The cancellation terms set out above apply. Any request for cancellation or postponement must be made by sending a letter addressed to La Pensée Sauvage Normandie:

3. In the very exceptional event that the Service Provider is required to cancel a stay, the Service Provider must comply with the following terms:
- Up to 30 days before the start of the stay: a full refund of the deposit paid by the Customer.
- From 29 days to 16 days before the start of the stay: full refund of the deposit paid by the Customer, together with a voucher worth €150 (including VAT) to be used on a future stay (excluding treatments and the shop).
- From 15 days before the start of the stay: no cancellation possible, except in cases of force majeure (see Article XI).
4. In the event of failure to comply with the Centre’s internal regulations, the Service Provider reserves the right to terminate the stay at the Customer’s expense. These regulations are available in the appendix to these T&Cs and upon arrival at the Centre.
VI. CHECK-IN/CHECK-OUT
The reserved room is available to the Guest from 4.00 pm on the day of arrival until 1.00 pm on the day of departure. The Provider undertakes to provide the Guest with a room corresponding to the category for which they have made a booking. However, the Guest may under no circumstances demand a specific room or use this request as grounds for a dispute. In the case of a first stay at La Pensée Sauvage Normandie, the Guest will be asked to provide a valid form of identification (identity card or passport), which they must supply.
VII. LIMITATION OF LIABILITY
The Guest has access to a safe in their room for the secure storage of their valuables. The Provider accepts no liability for the loss, theft or damage of such items if they have not been placed in the safe.
VIII. CHANGES TO ACTIVITIES
The Service Provider reserves the right to modify or cancel planned outdoor activities should weather conditions render them impossible.
IX. FORCE MAJEURE
- The Service Provider shall not be held liable for any failure to perform its obligations if such failure is due to the occurrence of an event constituting a case of force majeure rendering it impossible to operate the centre, such as, but not limited to: flooding, fire, storm.
- The Client (or its representatives) shall not be held liable for the non-performance of its obligations if such non-performance is due to the occurrence of an event constituting force majeure, such as, but not limited to: an accident causing physical injury, emergency hospitalisation, or death.
- The party affected by such events (or its representatives) must inform the other party without delay of their occurrence and keep supporting documents proving them at the other party’s disposal.
- The parties agree that they must consult with one another as soon as possible in order to determine jointly and amicably the terms for fulfilling the order.
X. INTELLECTUAL PROPERTY
All logos, trademarks, photographs and designs appearing on La Pensée Sauvage Normandie’s marketing materials are its property. Any partial or complete reproduction of these materials, in any medium, for commercial, charitable or voluntary purposes, is prohibited without the consent of the Service Provider and the owners of the trademarks or rights associated with these graphic representations.
XI. FINAL PROVISIONS
These General Terms and Conditions and the registration form sent to the Client form a single contractual document and constitute the entirety of the contractual relationship between the parties. The contract concluded between the Service Provider and the Customer is governed by French law. Any dispute and/or claim arising from the provision of services and/or relating to the validity, interpretation and/or performance of these T&Cs shall be subject to the exclusive jurisdiction of the French courts. In the event of any amendment to the terms of these GTC, the version in force on the date the Client actually booked the stay shall prevail. In the event of any matter not covered by these GTC, the relevant statutory provisions shall apply.
XII. COMPLAINTS
During the stay: the Service Provider’s entire team is available to the Customer throughout their stay to address any concerns they may have and resolve any issues that arise.
After the stay: any complaint must be made in writing by registered post with acknowledgement of receipt addressed to La Pensée Sauvage Normandie. Domaine de Forges. Avenue des Sources. 76 440 Forges-les-Eaux as soon as possible and no later than 6 (six) months after the end of the stay. Any supporting documents must be enclosed to enable the Service Provider to process the complaint.
